Responsible Person
EC Regulation 1223/2009 on cosmetic products came into effect in July 2013. In a nutshell, it states that every cosmetic product sold on the EU market must have a ‘Responsible Person’ who guarantees its compliance and safety for human health. And it’s mandatory. There’s just no two ways about it!
But who is this ‘Responsible Person’? First and foremost, it must be a legal or natural person based in the EU. And in broader terms, this ‘person’ is a manufacturer, an importer, a distributor, or a third party designated by the manufacturer or the importer.
TLogistics can set up a legal entity in the Netherlands (EU) to act as your Responsible Person (RP). You appoint this legal entity to be your RP by written mandate. Your RP then accepts this role and their obligations in writing.
- ‘manufacturer’ means any natural or legal person who manufactures a cosmetic product or has such a product designed or manufactured, and markets that cosmetic product under his name or trademark
- ‘importer’ means any natural or legal person established within the Community, who places a cosmetic product from a third country on the Community market
- ‘distributor’ means any natural or legal person in the supply chain, other than the manufacturer or the importer, who makes a cosmetic product available on the Community market.
